Creating an account or using the platform means you accept these terms. If you do not accept them, do not use the service.
1. What PolicyFX is, and is not.
PolicyFX is tracking and recommendation software for foreign exchange exposure, policy compliance, and reporting. It does not execute trades, quote executable rates, hold client funds, act as a broker or dealer, or provide financial advice.
Rates shown in the platform are indicative only. You execute with your own bank or broker, at that provider's quoted rate.
2. Eligibility and account.
The service is intended for businesses operating in Canada. You must be authorized to bind your organization to these terms.
You are responsible for your credentials and for all activity under your account.
3. Subscription, billing, and cancellation.
Direct subscriptions are billed in Canadian dollars through Stripe on the monthly or annual term selected at sign-up.
Fees are non-refundable except where required by law. You may cancel at any time in the platform. Cancellation takes effect at the end of the current billing period.
4. Acceptable use.
You agree not to reverse engineer the platform, attempt to access another tenant's data, upload unlawful content, use the service to circumvent sanctions or anti-money-laundering requirements, or resell access without written permission.
5. Your data.
You own the data you upload. You grant PolicyFX a limited license to process it solely to provide the service. Personal information is handled under the Privacy policy.
6. Intellectual property.
The PolicyFX platform, including its software, design, copy, and recommendation logic as implemented, belongs to PolicyFX Inc. and its licensors.
Your subscription grants a limited, non-exclusive right to use the service. It transfers no ownership.
7. Service availability.
We target high availability. We do not guarantee uninterrupted service. Maintenance windows and incident notices are posted in-platform or sent to the account email.
8. Disclaimers.
The service is provided "as is." PolicyFX is not a registered investment adviser, dealer, or money services business.
Nothing in the platform is financial, accounting, tax, or legal advice. Coverage flags, policy ratios, and indicative rates are informational signals, not instructions to trade.
9. Limitation of liability.
To the maximum extent permitted by law, PolicyFX's total liability for any claim arising out of the service is capped at the fees you paid in the twelve months before the claim.
We are not liable for indirect or consequential losses, or for losses on foreign exchange transactions you execute with third parties.
10. Termination.
Either party may terminate for material breach not cured within thirty days of written notice. We may suspend access for non-payment or for activity that threatens platform security.
After termination, you may export your data for sixty days.
11. Governing law.
These terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of laws rules. The courts of Ontario have exclusive jurisdiction.
12. Changes.
We may update these terms. Material changes will be sent by email or posted in-platform at least thirty days before they take effect.
